This Privacy Policy describes how we collect, use, and disclose your Personal Information when you visit or make a purchase from the Site. It applies to all visitors and customers worldwide.

Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

Disclosure for a business purpose: shared with our processors Shopify (store and payments), Klaviyo (email and SMS messaging), Upstack Data (analytics and attribution), and Loox (product reviews).

Customer support information

Examples of Personal Information collected: name, email address, phone number, order number, and any other information you choose to include in your message to us.

Purpose of collection: to provide customer support.

Minors

We do not knowingly collect Personal Information from anyone under the age of 16, and the Site is not directed to children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address below to request deletion. We do not knowingly sell or share the Personal Information of consumers under 16 years of age.

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

We may also transfer your Personal Information in connection with a merger, acquisition, or sale of all or part of our business. Because our service providers operate internationally, your Personal Information may be stored and processed in Canada, the United States, and other countries where our processors operate. Where required, these transfers are made under the European Commission's Standard Contractual Clauses or the UK International Data Transfer Addendum.

We take reasonable steps to protect your Personal Information from loss, misuse, unauthorised access, disclosure, alteration and destruction, including encryption in transit and access controls on our systems. Using Personal Information

We use your personal information to provide you with the Services in order to perform our contract with you, including to process your payments, fulfill your orders, to send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges and to enable you to post reviews.

• Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you advertisements for products or services (including abandoned checkout reminders). This may include using your personal information to better tailor the Services and advertising on our Site and other websites. We send marketing text messages only where you have given prior express written consent, and you can withdraw that consent at any time by replying STOP to any message. You can unsubscribe from marketing emails using the link at the bottom of any message. You will continue to receive transactional messages about your orders.

Lawful basis

Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”) or the United Kingdom, we process your personal information under the following lawful bases:

• Your consent – for marketing communications and non-essential cookies;

• The performance of the contract between you and the Site – to process and deliver your orders;

• Compliance with our legal obligations – to retain tax and transaction records;

Retention

When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase this information. Specifically, we retain order and transaction records for [7] years in order to meet tax and accounting obligations, customer support records for [3] years, and marketing contact details until you unsubscribe or ask us to delete them. Automatic decision-making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

• Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.

• Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

GDPR and UK GDPR

If you are a resident of the EEA or the United Kingdom, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. If you would like to exercise these rights, please contact us through the contact information below.

You also have the right to restrict our processing of your Personal Information, to object to processing carried out on the basis of our legitimate interests, and to withdraw your consent at any time where we rely on consent. Withdrawing consent does not affect the lawfulness of processing carried out before you withdrew it. You have the right to lodge a complaint with your local data protection supervisory authority, or with the Information Commissioner's Office if you are in the United Kingdom. We will respond to requests within one month.

Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. In the preceding 12 months we collected the categories of Personal Information described in the “Collecting Personal Information” section above, from the sources and for the purposes stated there, and disclosed those categories to the service providers and advertising partners named in the “Sharing Personal Information” section. We do not collect or process sensitive Personal Information for the purpose of inferring characteristics about you.
